Terms and Conditions of the EuroFrance Online Shop

Effective from: 17.02.2024

I. Definitions

Terms used in the Rules and Regulations shall mean:

  • EuroFrance: owner of the Internet Shop offering sale of Goods via the Internet Shop, i.e., EUROFRANCE Marcin Bednarczyk I Konrad Kruczek Sp.K., based in Bielsko-Biała, NIP: 9372219834 REGON: 072195068;
  • Customer: a natural person, a legal person or an organisational unit that is not a legal person but to which specific provisions grant legal capacity, who places an Order from the Online Shop. The Customer is also a Consumer;
  • Consumer: a natural person making a legal transaction not directly connected with his/her economic or professional activity;
  • Product: the Goods or Digital Goods available on the Website;
  • Civil Code: the Act of 23 April 1964, the Civil Code;

II. General provisions

The Terms and Conditions set out the rules for the use of the Online Shop.

III. Rules of Using the Internet Shop

Registration within the Online Shop is optional. Customers may place an Order without registering.

  • By placing an Order without registering with the Online Shop, the Customer accepts the Terms and Conditions and Privacy Policy.
  • Registration occurs by creating an account via a dedicated form available in the Online Shop.
  • Registration requires the provision of personal data marked as mandatory.
  • With registration, the Customer accepts the provisions of the Terms and Conditions and Privacy Policy.

EuroFrance may deprive the Customer of the right to use the Internet Shop and may also restrict access to parts of the Shop, with immediate effect, if the Customer violates these Regulations or the law, particularly in cases of:

  • Providing incorrect, inaccurate or out-of-date information;
  • Infringing personal rights of third parties through actions within the Online Shop;
  • Any other behaviour considered by EuroFrance to be in breach of current legislation or the general principles of Internet use, or detrimental to the company's reputation.

IV. Procedure for the Conclusion of the Agreement

To conclude a Contract via the Online Shop, it is necessary to:

  1. Enter the Online Shop and make a selection of Goods by taking subsequent technical actions based on the messages displayed to the Customer and information available within the Online Shop.
  2. Select the ordered Goods by adding them to the shopping basket.
  3. Modify the selection or entered data (if necessary) before finalising the Order.
  4. Provide personal data marked as mandatory and press the button confirming the Order.
  5. The sending of the Order by the Customer constitutes a declaration of intent to conclude a Contract in accordance with the provisions of the Regulations.

The Contract is deemed concluded at the moment of confirmation of the Order by EuroFrance. The Customer will receive a return email containing all significant elements of the Order.

V. Delivery

Delivery of the Goods is subject to the terms and conditions outlined under the "Payment and Delivery" and "Order Processing" sections available during the Order process or as otherwise displayed.

  • The delivery period depends on the actions taken by the courier company and is counted from the day EuroFrance sends its confirmation of the Order.
  • Any damages to the Goods during delivery should be reported immediately to the courier company, except in cases where the Goods were defective before being handed over for delivery.

VI. Prices and Payment Methods

The prices of the Goods are quoted in Polish Zloty and include all components, including VAT, customs duties and any other components.

Customers have the option to pay the price in accordance with the methods described in the "Payment and Delivery" tab or as displayed during the Ordering process.

VII. Right of Withdrawal

Applies to the Consumer:

  • The Consumer has the right to withdraw from the Contract. The withdrawal period shall expire 14 days after the day on which the Consumer has taken possession of the Goods, or on which a third party other than the courier company has taken possession of the Goods on behalf of the Consumer.
  • To exercise the right of withdrawal, the Consumer must inform EuroFrance of his/her decision to withdraw from the Contract in writing or via the form available at: https://www.eurofrance24.com/return.
  • In the event of withdrawal, all payments received from the Consumer, including the costs of delivering the Goods (except for additional costs resulting from a type of delivery other than the least expensive type offered by EuroFrance), shall be reimbursed without undue delay and in any event no later than 14 days from the day on which EuroFrance is informed about the decision to withdraw from the Contract.

VIII. Complaints Concerning Goods

Applies to the Consumer:

  • EuroFrance is obliged to deliver the Product in conformity with the Contract. The Customer is encouraged to inspect the package at the time of delivery to verify the absence of any damages or defects.
  • If the Goods received are not in conformity with the Contract at the time of delivery, the Consumer may exercise his/her rights under the Consumer Warranty for a period of two years from the date of delivery of the Goods.
  • The Consumer can demand that the Goods be replaced with new ones, or make a declaration to reduce the price or withdraw from the Contract, subject to the conditions stipulated by the Consumer Rights Act.
  • Any complaints should be reported to EuroFrance via the contact email provided, specifying the nature of the non-conformity and the desired resolution.

IX. Warranty on Sale of Goods

EuroFrance may, as part of a specific offer, specify its liability on the basis of the warranty provided. The warranty period and conditions will be specified separately for each of the Goods within the Goods specification.

Complaints submitted without specifying the basis (warranty or guarantee) will be processed on the basis of the EuroFrance warranty policy, using the form available within the "Returns / Complaints" tab on the website.

X. Digital Security

EuroFrance takes care of the digital security of the webshop while respecting the users' rights to use the functionalities of the webshop and to express their opinion or act according to their own choices.

The Online Shop does not use algorithms in the decision-making processes. Users may sort the Goods according to their own preferences without any automatic filtering.

Advertisements, if displayed, will be based on user preferences concerning cookie settings and browser configurations, in compliance with personal data protection regulations.

XI. Complaints Regarding Provision of Electronic Services

EuroFrance ensures that the Online Shop operates correctly according to current technical knowledge and undertakes to rectify any reported malfunctions or interruptions in service within a reasonable period of time.

Irregularities related to the functioning of the Online Shop should be reported via email to: info@eurofrance.com, including details of the issue and its occurrence.

VII. Right of Withdrawal

Applies to the Consumer:

  • The Consumer has the right to withdraw from the Contract. The withdrawal period shall expire 14 days after the day on which the Consumer has taken possession of the Goods, or on which a third party other than the courier company has taken possession of the Goods on behalf of the Consumer.
  • To exercise the right of withdrawal, the Consumer must inform EuroFrance of his/her decision to withdraw from the Contract in writing or via the form available at: https://partsauto360.com/i/returns-en.
  • In the event of withdrawal, all payments received from the Consumer, including the costs of delivering the Goods (except for additional costs resulting from a type of delivery other than the least expensive type offered by EuroFrance), shall be reimbursed without undue delay and in any event no later than 14 days from the day on which EuroFrance is informed about the decision to withdraw from the Contract.

XII. Out-of-Court Complaint and Redress Procedures

EuroFrance allows the use of out-of-court complaint and redress procedures. These procedures are voluntary and can only take place if both parties to the dispute agree to it.

  • The consumer may apply to the Trade Inspection to initiate proceedings for out-of-court settlement of consumer disputes concerning the concluded Agreement.
  • The consumer may also request that a dispute concerning the concluded Agreement be examined by a permanent arbitration court operating at the relevant provincial inspectorate of the Trade Inspection.
  • The European Commission also provides a platform for online dispute resolution between consumers and traders (ODR platform), available at http://ec.europa.eu/consumers/odr/.

XIII. Protection of Personal Data

EuroFrance acts as a personal data controller and ensures the protection of personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation).

  • The personal data will be processed for the proper performance of the Contract, and after its termination, for the period required for the limitation of claims, in accordance with applicable law.
  • Recipients of the personal data may include service providers, payment system operators, and legal and advisory service providers.
  • Customers have the right to access, rectify, erase, or restrict processing of their data, and to object to processing as well as the right to data portability.

XIV. Liability and Force Majeure

Both parties shall be exempt from liability in the case of force majeure circumstances, which include events of external, accidental, or natural nature such as natural disasters, war, epidemics, and similar events that significantly impede contract performance.

  • If force majeure circumstances occur, the affected party must notify the other party immediately.
  • If these circumstances do not cease to exist, or it is impossible to determine when they will cease to exist, either party may terminate the Agreement with immediate effect.

XV. Final Provisions

The competent court for disputes with Consumers shall be the court with jurisdiction according to the applicable general law. Disputes arising between EuroFrance and a Customer who is not a Consumer shall be submitted to the competent court for the seat of EuroFrance.

In matters not regulated by these Terms and Conditions, the provisions of applicable Polish law shall apply. Should any contradictions arise between these Terms and Conditions and universally applicable laws, the provisions of Polish law shall prevail.
